Logic 9: Tool Box via escape won't stay visible

I can get the tool selection drop down box to stay on screen if I go over to the usual place in the top right hand corner and click on the pencil etc. tools, but when I press ESC it won't stay on screen - doesn't give me time to make a selection.

 

Anyone have a suggestion as to a setting to make it hang?
