I dunno about the lawsuit, cuz they don't warranty their software to work at all. Seriously. Anyway, I've been struggling lately with exactly what you've described. It certainly doesn't appear to be sample-accurate under various conditions. It just kills me how some of the features of this software are so... Oh, never mind...
